Basra: Legal expert Ali Al-Tamimi has elucidated the circumstances under which a lawsuit may be transferred from one court to another.

According to National Iraqi News Agency, Al-Tamimi stated that the jurisdiction for an investigation is primarily determined by the location where the crime was committed, either in whole or in part. He further explained that transferring a lawsuit from one investigative court’s jurisdiction to another can occur through a decision by the Chief Justice of the Judicial Council, the Federal Court of Cassation, or the Criminal Court within its jurisdiction.

Al-Tamimi highlighted that lawsuits might be transferred if security conditions necessitate it or if such a move would assist in uncovering the truth. He also referenced Articles 53 and 55 of the Criminal Procedure Code No. 23 of 1971, which outline the procedures for transferring a lawsuit.

Recently, there have been calls to move the investigation into the death of young doctor Ban Ziyad from Basra to Baghdad, underscoring the relevance of Al-Tamimi’s explanations.
