Legal expert: Parliament’s Building Is Not Among The Conditions For The Validity Of Convening And Voting

Baghdad Legal expert Salem Hawas Al-Saadi said, “Based on the Iraqi Constitution of 2005, Parliament Law and its formations No. 13 of 2018, and Law on replacing members of Parliament No. 6 of 2006, and the bylaw of the House of Representatives, there is no legal or constitutional objection to holding sessions Parliament outside its current building.

He added that, “This is legally permissible and is in accordance with the legal text of the bylaw of the House of Representatives published in the Iraqi Gazette No. 4032 dated 2/5/2007, which included 152 legal articles, especially Article 21 of it.”

He pointed out that Article 21 of the bylaw stipulates that “the sessions of the Council shall be held in Baghdad and may be held in other places when necessary. And this is a broad concept of convening anywhere in the land of Iraq, as the location is not part of the conditions for convening, voting or quorum.

Hawas said, “Voting, meeting, and quorum have conditions set by the constitution, the bylaw, the law of the House of Representatives and its formations, where there is no mention of the place as part of it or the validity of its convening, but on the contrary, it is permissible when necessary.
